Welcome to Cipreses Tourism! These Terms of Service ("Terms") govern your use of our website, booking services, and tourism experiences provided by Cipreses Tourism, a Canadian tourism company.

1. Acceptance of Terms

By accessing our website, making a booking, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these terms, please do not use our services.

4. Booking and Payment Terms

4.1 Booking Process

  • All bookings must be confirmed in writing via email
  • A deposit is required to secure your reservation
  • Full payment is due 30 days before tour departure
  • Late bookings (within 30 days) require immediate full payment

4.2 Payment Methods

We accept major credit cards, bank transfers, and certified checks. All prices are in Canadian Dollars (CAD) unless otherwise specified.

4.3 Price Changes

Prices are subject to change due to currency fluctuations, fuel surcharges, or government tax increases. Once full payment is received, prices are guaranteed.

5. Cancellation and Refund Policy

5.1 Cancellation by Client

  • More than 60 days before departure: Full refund minus 10% administrative fee
  • 30-60 days before departure: 50% refund
  • 15-30 days before departure: 25% refund
  • Less than 15 days before departure: No refund

5.2 Cancellation by Cipreses

We reserve the right to cancel tours due to insufficient bookings, weather conditions, or unforeseen circumstances. In such cases, clients receive a full refund or can transfer to an alternative tour.

6. Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance covering trip cancellation, medical expenses, and emergency evacuation. Cipreses Tourism is not responsible for costs arising from medical emergencies, trip cancellations, or travel delays.

7. Health and Safety Requirements

7.1 Physical Requirements

Some tours require a moderate to high level of physical fitness. Clients must honestly assess their abilities and inform us of any medical conditions that might affect their participation.

7.2 Age Restrictions

Minimum age requirements vary by tour. Children under 16 must be accompanied by a parent or guardian.

7.3 Safety Guidelines

Clients must follow all safety instructions provided by our guides. Failure to comply may result in removal from the tour without refund.

8. Liability and Responsibility

8.1 Limitation of Liability

Cipreses Tourism acts only as an intermediary between clients and service providers (hotels, transportation, etc.). We are not liable for:

  • Acts of nature, weather conditions, or natural disasters
  • Political unrest, strikes, or government actions
  • Delays or cancellations by third-party service providers
  • Personal injury, illness, or death
  • Loss or damage to personal property

8.2 Maximum Liability

Our maximum liability for any claim is limited to the total amount paid by the client for the specific tour in question.

9. Travel Documents and Requirements

Clients are responsible for ensuring they have valid passports, visas, and any required health certificates. We provide general guidance but are not responsible for denied entry or other document-related issues.

10. Behavior and Conduct

Clients are expected to behave respectfully toward guides, other travelers, and local communities. We reserve the right to remove disruptive participants without refund.

11. Force Majeure

Neither party shall be liable for failure to perform due to causes beyond reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government regulations, or natural disasters.

12. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through:

  1. Direct negotiation between parties
  2. Mediation through a recognized Canadian mediation service
  3. Arbitration under the laws of Quebec, Canada

13. Governing Law

These Terms are governed by the laws of Quebec and Canada. Any legal proceedings must be conducted in Montreal, Quebec.

14. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. We comply with Canadian privacy laws including PIPEDA.

15. Modifications to Terms

We may update these Terms periodically. Continued use of our services after changes constitutes acceptance of the new terms. We will notify clients of significant changes via email.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
